Governing the Use of Taifa Mobile Ltd Services

1. Introduction

Welcome to Taifa Mobile Ltd. By accessing or using our Airtime services, you acknowledge and agree to be bound by these Terms & Conditions. Please review them carefully before using the platform.

These Terms & Conditions form a legally binding agreement between you and Taifa Mobile Ltd regarding your access to and use of our platform and related services. If you do not agree with any part of these terms, you should discontinue use of the services.

2. Description of Services

A bulk airtime distribution platform for businesses with capabilities including:

  • Purchase airtime
  • Send airtime directly to customers using their mobile numbers.
  • Monitor sales and generate revenue reports.
  • Maintain transaction records and dispatch history.
  • Uploading recipient lists through CSV files or manual entry.
  • Scheduling and recurring transaction options.
  • Detailed financial and activity reports.

3. User Accounts

To use Taifa Mobile Ltd Airtime services, users must create an account. By registering, you agree that:

  • Information provided during registration must be accurate, current, and complete.
  • Login credentials must remain confidential and must not be shared with unauthorized persons.
  • For security and regulatory purposes, login location details (country, region, and city) may be collected based on IP address information.
  • You are responsible for keeping your account information up to date.
  • Organizations using multi-user accounts must appoint administrators to manage access rights and permissions.
  • Taifa Mobile Ltd reserves the right to suspend or terminate accounts that breach these Terms & Conditions.

4. Payments and Account Funding

Account top-ups and payments must be made through approved channels, including:

  • Mobile money payments using designated till numbers.
  • Credit and debit card payments processed through secure gateways.
  • Bank transfers for approved enterprise accounts.
Payment Policies
  • Funds deposited into a Taifa Mobile Ltd account are non-refundable except where required by law.
  • Transaction charges imposed by payment providers are outside Taifa Mobile Ltd’s control.
  • Account balances do not earn interest and should not be treated as banking or savings facilities.
  • Accounts that remain inactive for more than twelve (12) months may incur maintenance charges.

5. Airtime Distribution

Use of the airtime distribution service is subject to the following:

  • Transaction success depends on network availability and the status of the recipient’s mobile account.
  • Users will receive SMS and in-app notifications confirming each transaction.
  • Failed transactions will be credited back to the account balance within forty -eight (48) hours.
  • Bulk distributions may be processed in stages and may not complete simultaneously.
  • Recipients must have active accounts with supported mobile network operators.
  • Taifa Mobile Ltd is not liable for airtime sent to incorrect numbers due to user error.

6. Reporting and Scheduling Features

Reporting

Customers have access to:

  • Downloadable transaction reports in CSV, Excel, and PDF formats.
  • Monthly summaries may be sent to registered email addresses upon request.
  • Custom reports based on selected periods and transaction categories.
  • Report storage for up to twenty-four (24) months.
Scheduling

Users may:

  • Schedule one-time transactions up to ninety (90) days in advance.
  • Configure recurring transactions on daily, weekly, monthly, or custom schedules.
  • Modify or cancel scheduled transactions up to one hour before execution.
  • Set notification preferences for scheduled activities.

7. Limitation of Liability

Although Taifa Mobile Ltd strives to provide reliable and uninterrupted services:

  • We are not responsible for delays or interruptions caused by telecommunications providers or other third parties.
  • Our total liability for any claim shall not exceed the value of the airtime directly associated with that claim.
  • Taifa Mobile Ltd shall not be liable for indirect, incidental, consequential, special, or punitive damages.
  • Service availability may occasionally be affected by maintenance or technical disruptions.
  • Obligations may be suspended during events beyond our reasonable control, including force majeure circumstances.

8. Privacy and Data Protection

Taifa Mobile Ltd processes personal information in accordance with its Privacy Policy and applicable laws.

Accordingly:
  • Personal data is collected only to the extent necessary for service delivery.
  • Appropriate security measures are implemented to safeguard information.
  • Transaction records are retained for compliance and service improvement purposes.
  • Users have the right to access, correct, or request deletion of their personal data where legally permissible.
  • Information may be shared with trusted service providers involved in delivering the services, but Taifa Mobile Ltd does not sell personal data to third parties.

9. Intellectual Property

All intellectual property associated with Taifa Mobile Ltd remains the exclusive property of Taifa Mobile Ltd.

This includes:
  • The Taifa Mobile Ltd name, trademarks, logos, and branding elements.
  • Software, designs, graphics, text, and related content protected under copyright laws.
  • A limited, non-transferable license granted to users solely for authorized use of the platform.
  • Any reproduction, alteration, or redistribution of platform materials without prior written consent is prohibited.
  • API users must comply with applicable technical documentation and attribution requirements.

10. Termination

Either party may terminate this agreement as follows:

  • Users may close their accounts through account settings or by contacting customer support.
  • Taifa Mobile Ltd may suspend or terminate accounts involved in violations of these terms, unlawful activities, or prolonged inactivity.
  • Upon termination, users must cease using all Taifa Mobile Ltd services.
  • Remaining balances below KSh 50 may be forfeited upon account closure.
  • Balances above this amount may be refunded subject to applicable processing charges.
  • Provisions concerning liability, dispute resolution, and intellectual property shall continue to apply after termination.

11. Amendments to These Terms

  • Taifa Mobile Ltd reserves the right to modify these Terms & Conditions from time to time.
  • Material changes will be communicated by email at least fourteen (14) days before taking effect.
  • Continued use of the platform constitutes acceptance of revised terms.
  • Users who do not agree with any amendments should discontinue use of the services.
  • The latest version of these Terms will always be accessible on the Taifa Mobile Ltd website.
  • Enterprise clients operating under separate agreements may be subject to different notification requirements.

12. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by the laws of the jurisdiction in which Taifa Mobile Ltd Technologies Ltd is incorporated.

In the event of a dispute:
  • The parties shall first seek an amicable resolution through good-faith negotiations.
  • Where negotiations fail, the matter shall be referred to mediation under mutually agreed rules.
  • If mediation does not resolve the dispute, it shall be submitted to binding arbitration.
  • Arbitration proceedings shall be conducted in English in the city where Taifa Mobile Ltd maintains its principal offices.
  • The arbitrator’s decision shall be final and binding upon both parties.
